Accommodation companies urged to halt demanding deposit from NSFAS funded students



The National Student Financial Aid Scheme (NSFAS) has urged landlords to not demand a deposit or top-up payment from NSFAS-funded students.

This comes soon after NSFAS obtained experiences about some accommodation companies who demand NSFAS-funded students to pay for a deposit or top-up payment in an effort to get access to the accredited private accommodation.

"NSFAS reminds accommodation companies of the obligatory conditions, as supplied by the Standardised Fixed-Term Lease Settlement between the private accommodation vendors and NSFAS funded students," NSFAS mentioned in an announcement on Thursday.

The Standardised Fixed-Term Lease Agreement states the rent is going to be paid regular monthly for the accommodation provider (lessor) by NSFAS, on behalf of your lessee (NSFAS funded student), in accordance with the NSFAS terms and conditions for private accommodation suppliers’ participation on the student accommodation portal.

"The lessor may not demand or allow the lessee to pay a deposit, top-up payments, or every other sorts of payment for the lessor, or any other person in reference to this agreement, which include payment of hire, when awaiting payment from NSFAS. The lessor shall have no recourse versus the lessee for any default while in the payment of rent by NSFAS," the arrangement reads.

The NSFAS terms and conditions for private accommodation suppliers’ participation on the student accommodation portal also states that: "Where the NSFAS-funded student is defunded as a result of an incorrect determination by NSFAS, the student will not be answerable for payment of read more any arrear rent towards the accommodation company, up read more until the day of being defunded."

NSFAS described that wherever the NSFAS-funded student chooses to carry on occupying the leased premises, notwithstanding becoming defunded by NSFAS, the nsfas login student is going to be chargeable for payment of hire into the lessor in the date of getting defunded.

"Where the student is defunded by NSFAS due to a misrepresentation by the lessee/guardian at any stage, the student must immediately vacate the leased property; and will be liable for payment of all rent due to the accommodation provider.

"Where the student moves, accommodation providers without the read more prior approval of NSFAS, NSFAS may elect not to pay any rental to the new accommodation provider, and any such rental payments will be for the student own account," the scheme said.
